Question12. Does G.L. c. 71A apply to students receiving special education services

or accommodations for disabilities?

            Under Section 4 of G.L. c. 71A, special educational programs for students with disabilities“shall be completely unaffected.”  Therefore, services delivered according to an Individualized Education Program (IEP) or 504 Plan for students with disabilities are unaffected by the requirements of G.L. c. 71A. 

            If a student with disabilities has an IEP or a 504 Plan that requires instruction to be provided to the student in a language other than English, then the district must comply with the IEP or 504 plan in this regard, and no waiver is required.

    Are you aware of any documents that assist with FLEP for stduents with disabilities and also any for guidance on ELD levels for ELLSWD?

    Please share any resources you have found or any practices currently in place in your school or district.
